These Terms of Service govern your use of digiartdental.com and the dental case management platform and laboratory services provided by DIGIART DENTAL STUDIOS LTD (“we”, “us”), a private limited company registered in Kenya (Company No. PVT-6Y1Y735L).
1. Agreement to these terms
By creating an account, submitting a case, or otherwise using our services, you agree to these terms. If you use the services on behalf of a clinic, hospital, or other organisation, you confirm that you are authorised to accept these terms on its behalf, and “you” refers to that organisation.
2. Our services
We provide:
- an online platform for submitting, tracking, and managing dental cases between clinics, technicians, and laboratories;
- dental laboratory services, including the design and fabrication of dental prostheses and appliances as described in each order;
- invoicing and payment collection, including through M-Pesa.
We may improve, change, or discontinue features of the platform from time to time.
3. Accounts and access
- You must provide accurate account information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorised access.
- Account administrators are responsible for the team members and permissions they grant within their workspace.
4. Clinic responsibilities
When you submit a case, you confirm that:
- the prescription, measurements, impressions, scans, shade, and other instructions are accurate and complete, and were prepared by a qualified dental professional;
- you have obtained any patient consent required by law to share patient information with us for the purpose of fulfilling the case;
- clinical decisions, diagnosis, treatment planning, and the fitting of any restoration remain your professional responsibility.
5. Orders and production
- An order is accepted when we confirm it on the platform. We may decline or put a case on hold if the information or materials provided are incomplete or unsuitable, and we will tell you why.
- Turnaround times shown are estimates. We will keep the case status updated and let you know about material delays.
- Changes requested after production has started may affect the price and delivery date.
6. Pricing and payment
- Prices are as quoted on the platform or in your invoice, in Kenya Shillings unless stated otherwise.
- Invoices are payable by the due date shown, by M-Pesa or another method we accept. Payment is complete when we receive confirmation of the funds.
- We may pause new work for accounts with overdue balances until they are settled.
7. Delivery
We will deliver completed cases to the address or by the method agreed for the order. Please inspect each case on receipt and report any visible damage or discrepancy as soon as possible.
8. Quality, adjustments, and remakes
We take care to produce every case to a high standard according to the prescription provided. If a case does not meet the prescription or has a manufacturing defect, contact us promptly with details and, where possible, photos. We will assess the case and, where the issue is due to our workmanship, adjust or remake it at no extra charge. Remakes needed because of incorrect or incomplete information, impressions, or scans supplied with the case may be charged.
9. Acceptable use
You agree not to:
- use the services for any unlawful purpose;
- upload content you do not have the right to share, or that contains malware;
- attempt to access other users' data or accounts, or interfere with the security or operation of the platform;
- copy, resell, or reverse engineer the platform except as allowed by law.
10. Intellectual property
The platform, its software, design, and branding belong to DIGIART DENTAL STUDIOS LTD. You keep ownership of the case information and files you submit, and grant us permission to use them only as needed to provide the services to you.
11. Privacy and data protection
We handle personal data in line with the Kenya Data Protection Act, 2019 and our Privacy Policy, which forms part of these terms.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, such as loss of profit, revenue, or goodwill, or for losses caused by inaccurate information or materials supplied to us. Our total liability for any claim relating to an order is limited to the amount paid for that order. Nothing in these terms limits liability that cannot be limited under Kenyan law, including rights under the Consumer Protection Act, 2012.
13. Indemnity
You agree to compensate us for claims, losses, and costs arising from your breach of these terms, from inaccurate case information you supply, or from your clinical use of the products we provide.
14. Suspension and termination
You may stop using the services at any time. We may suspend or close an account that breaches these terms, has unpaid balances, or puts the security of the platform at risk. Amounts owed for completed work remain payable after termination.
15. Changes to these terms
We may update these terms from time to time. The latest version will always be on this page with its effective date. Continuing to use the services after a change means you accept the updated terms.
16. Governing law and disputes
These terms are governed by the laws of Kenya. We will first try to resolve any dispute through good-faith discussion. If it cannot be resolved, it will be submitted to the courts of Kenya sitting in Nairobi.
